ISSUANCE DOSSIER FOR INVESTMENT CERTIFICATE OF DOMESTIC PROJECT WITHOUT INVESTIGATION.

Applied to a domestic project with investment scale from 15 billion VND to 300 billion VND and not in the list of conditioned investment field.

Dossier includes 04 similar sets, in which at least one is original, each set comprises the following documents:

Dossier includes 04 similar sets, in which at least one is original, each set comprises the following documents:

1. Registration form for issuance of investment certificate (standardized form).

2. Memorandum of agreement or contract between the investor and the infrastructure owner (also land lessor) about land lease ( if renting land), or about factory lease enclosing lessor’s acceptance document for renting factory (if renting factory).

3. Documents certifying legal status of the investor. (Business charter, notarized copy of business registration certificate or decision of enterprise establishment (if yes).

4. Report on the investor’s financial capability. (For enterprise under operation: audited financial statements of the two latest years or any other relevant document. For project that uses state capital: acceptance documents for using that capital amount or statement of investment decision).

Solving duration: within 05 working days.

2. ISSUANCE DOSSIER FOR INVESTMENT CERTIFICATE OF FDI PROJECT WITHOUT INVESTIGATION

Applied to a FDI project with capital of under 300 billion VND and not in the list of conditioned investment field

Dossier includes 04 similar sets, in which at least one is original, each set comprises the following documents:

1. Registraiton form for issuance of investment certificate (standardized form).

2. Documents certifying legal status of the investor. (for organizational investor, offering a notarized copy of business registration certificate, decision of enterprise establishment or other relevant document. For individual investor, offering a notarized copy of passport or ID card).

3. Memorandum of agreement between the investor and the infrastructure owner (also land lessor) about land lease (if renting land), or about factory lease enclosing lessor’s acceptance document for renting factory (if renting factory).

4. A contract of business co-operation in the case of co-operating to deploy the investment under that business co-operation contract.

5. Report on the investor’s financial capability. (For enterprise under operation: audited financial statements of the two latest years or any other relevant document. For project that uses state capital: acceptance documents for using that capital amount or statement of investment decision).

In the case that investment project accompanied with establishment of a new enterprise/economic organization, prepare more documents (file for business registration) as follows:

1. Business charter (company charter ) corresponding with each type of an enterprise. (Draft or official one is acceptable).

2. Contract of joint venture if establishing a new joint venture company between an (or some) internal investor and an (or some) external investor.

3. The list of founder-members (for Ltd., company or partnership company), the list of founder-shareholders (for joint stock company). The list must be enclosed with one of the following:

a). A copy of personal identification paper ( ID card or passport) of the founder-members, partners or the founder-shareholders if those are individuals.

b). A copy of enterprise’s establishment decision, business registration certificate or other relevant documents, business charter or other relevant documents, a copy of personal identification in the case of an authorized representative and decision of granting authority by the founder members, partners or the founder shareholders if those are legal entities..

c). The list of authorized representatives for the one member Ltd.,company and a copy of personal identification paper of each authorized representative. Document of granting authority by the company owner to the authorized person if company owner is an organization.

4. Confirmation document of legal capital if investing in any field that requires legal capital under the law.

5. A copy of practicing certificate if investing in any field that requires practicing certificate under the law.

Solving duration: within 05 working days.

DOSSIER FOR WORK PERMIT

At least 20 working days before a foreign employee is scheduled to start working for an enterprise, agency or organization in Vietnam, employer or Vietnamese partner has to submit dossier to authority for a work permit.

Dossier inludes the following documents in 01 set:

1. Application form written by the foreign employee (as stipulated).

2. Curriculum vitae written by the foreign employee (as stipulated).

3. Request form for issuance of work permit written by employer, Vietnamese partner or representative of a foreign non-governmental organization (as stipulated).

4. Criminal record by foreign authoriry. In the case that the foreign employee has inhabited in Vietnam for 06 months or more, criminal record by Vietnamese judicial department in the place where he/she is inhabiting.

5. Health certificate by foreign authority or by Vietnamese authority under the ragulation of Vietnam Ministry of health.

6. A copy of any documents certifying employee’s professional qualification, high technical skill such as university degree, Master or Doctor which fits the employer’s job speciality or requirements. In the case that the foreign employee is a traditional craftsman or is experienced in career or production management who has no certificate or degree, to submit confirmation of career experience for at least 05 years in his/her career or management by foreign company or authority.

7. 03 photos of 3cm x 4cm ( bare head, clearly see face and ears, no glasses, white background) within 06 months.

Notes:

1.1. In the case that the foreign employee moves internally the enterprize, replace the application form with a foreign enterprize’s statement of appointing the foreign employee to work for the subsidiary in Vietnam, in which clearly shows how long the foreign employee has worked for the enterprize.

1.2. In the case that the foreign employee executes a contract of economy, commerce, finance, banking, inssurance, technical science, culture, sport, education, health or a contract of service supply, to replace the application form with a contract between Vietnamese partner and foreign partner.

1.3. In the case that the foreign imployee represents a foreign non-government organization operating under the law of Vietnam, replace the application form with the orperation certificate of that foreign non-government organization in Vietnam.

1.4. Any of the above documents which are made or authenticated by a foreign body or organization has to be legalized consul then translated into Vietnamese and notarized under the law of Vietnam.

Management Board of Bac Giang's Industrial Parks: situation of industrial development for period 2006-2010

For period of 2006-2010, in Bac Giang, there have been 4 more industrial parks which were alllowed to establish by Government. They are Quang Chau Industrial park (2006), Van Trung industrial park and Song Khe-Noi Hoang industrial park (2007) and Viet Han industrial park (2009) which increase the number of Bac Giang Industrial parks to 5 and cover an area of 1,239 ha.
